It’s all about finding “viral” proof of guilt by association with the Chinese government in order to strip groups of their non-profit status.


Within hours of publication, this allegation migrated from State Armor’s limited readership to the wider right-wing echo-chamber, where outlets like Just the News blasted out the headline “This isn’t environmentalism — it’s economic warfare,” and the extremely online then riffed on the theme that climate lawsuits and induction stoves are all part of a giant communist conspiracy to destroy the U.S. Navy.

Or whatever.


Nine days later, Senator Ted Cruz convened “Enter the Dragon — China and the Left’s Lawfare Against American Energy Dominance,” a Judiciary subcommittee hearing named by Grok*, where witnesses repeated the State Armor claims and demanded that climate litigants like National Resources Defense Council and Climate Judiciary Project register as foreign agents until this can all be sorted out.


In his testimony, Scott Walter of the Capital Research Center (slogan: “America’s investigative think tank”), claimed Energy Foundation China was just the tip of the iceberg** and that big-name U.S. foundations are nearly all laundering hundreds of millions of Chinese dollars into “climate lawfare,” a phrase worth noting, since it’s going to be the next “adrenochrome,” if Cruz, Walter, and State Armor founder Nick Lucci get their way.


The concept has already landed successfully with the wider MAGA movement who are now indoctrinated: foreign money, progressive activism, and Chinese espionage are one and the same.

While this sounds like a tired right-wing Troll and Creep Show from 2009, it’s no longer just an irritating distraction to the real work of stopping the climate crisis because, well, the irritating distractions are in charge of the government now.


So what used to just be annoying is now an existential threat.


While earlier efforts focused on showy grievance politics public pressure campaigns, these emboldened Trump sycophants are now proposing laws with real teeth, and they are backed by legal and legislative decision-makers coordinating with Treasury powers, state attorneys general, and rich lobbying groups.


And all of this has an essential new feature: the idea that a group can be deemed a foreign proxy without any proof that the group actually received foreign instructions.

It’s a feature we saw worked extremely well when DOGE sank USAID by finding
“viral waste” instead of any actual evidence of wrongdoing.

The burden of proof has been dramatically lowered, and these trolls know it.

A week after the Ted Cruz show, Representative Lance Gooden proposed the “Think Tank and Non-Profit Foreign Influence Disclosure Act,” which would force every charity that receives more than $10,000 from a foreign “government or political party” (read, China) to itemize those donations in a public Treasury database.

The measure’s authors say the goal is transparency, but paired with the Senate talk of expanded
Foreign Agents Registration Act enforcement, it would give the Trump administration a ready list of groups to investigate, penalize, or simply target with memes.


The MAGA lawmakers have not hidden how they would use these powers if they get their proposals passed. As ever, to see the logical conclusion to the illogical, look to Marjorie Taylor Greene.


Also in June, Greene opened an Oversight Committee probe into Planned Parenthood, accusing the organization of “harvesting organs” and demanding a decade of financial records.


The investigation leans on the same logic Cruz and Gooden want to apply to climate and racial-justice groups: if public money mixes with progressive advocacy, the nonprofit’s exemption is on the chopping block.

A little further back into the timeline, we can see how the blueprint was in place right after the election. In November 2024 House Republicans passed
H.R. 9495, the “Stop Terror-Financing and Tax Penalties on American Hostages Act,” which empowered the Treasury Department to strip the tax-exempt status of any nonprofit it decides is “terrorist-supporting.”

That bill was marketed as a humanitarian gesture, but the fine print turned the Internal Revenue Code into a national-security cudgel.

The Treasury Secretary could label Energy Foundation China (or any U.S. group with non-U.S. staff) a “foreign political proxy,” which would trigger an automatic loss of 501(c)(3) status until the targeted group can prove otherwise; state attorneys general could cite the proxy designation as an excuse to freeze assets; donors, wary of subpoenas, flee; and all of this without any proof that a single dollar came with any actual foreign influence or instructions attached.


Devil’s advocate!


Wouldn’t the evidence suggest that this particular Chinese Plot to End America is one of the least successful Chinese plots ever, since oil and gas production hit record highs last year, imports of Chinese solar panels fell, and the consequences of the climate crisis continue to ravage U.S. communities? Or, perhaps, the plot is, in fact, working exactly as planned because China has achieved energy supremacy by cornering the global market on low-cost renewables while the U.S. is tripling down on catastrophically destructive high cost fossil fuels! IS THE REPUBLICAN PARTY A CHINESE OP?!?!


Anyways, the danger from all this isn’t limited to just tree-huggers and hippies. The legal architecture Republicans are assembling is broad enough to ensnare any group receiving funds from abroad or even just advocating a position someone in Washington deems “aligned” with a hostile power (Israel and Russia excepted).


A relief agency working in Gaza, a democracy-promotion nonprofit supported by European governments, a church with its headquarters outside the U.S., or a farmworkers’ clinic that takes a Canadian grant — they all could find themselves cast as foreign agents and stripped of their exemptions.

Sounds bad! So what to do?

Well, on the org front, foundations that support progressive causes could (should?) assume their cross-border grant files will be subpoenaed and should make a plan for how they’ll respond.


They could (should?) audit those files themselves and have high-level summaries ready for when Cruz and MTG come calling.


On the non-batshit Congress people front: legislators could work to curb the coming abuse by figuring out what the MAGA code words actually stand for (aka “climate lawfare”)and then strike the language in the bills or proposals before they become actionable.


On the regular-ol-person front: a regular-ol-person could call their legislator via the Capitol switchboard (202-224-3121) and say: “I’m a regular-ol-person and a constituent. I would like my representative to oppose any bill that lets Treasury revoke a charity’s tax-exempt status on an accusation alone. Specifically, please oppose H.R. 9495 and the Think Tank & Non-Profit Foreign Influence Disclosure Act. Thank you.”


A regular-ol-person person could also show up at an August-recess town hall and publicly ask their member of Congress: “So are you going to strip my church’s non-profit exemption just because Ted Cruz sees foreign proxies in his dreams?”
